General terms and conditions of business
We collect personal data to fulfill the contract or to register for an exam with a cooperation partner with your consent. Without providing your name, first name, and date of birth, it is generally not possible to register for an exam or a course/program. Providing an email address and (mobile) phone number is required for online bookings and is needed to contact you regarding the organization of the exam day. We expressly point out that, even for direct registrations by mail/fax, we are not able to inform you promptly about any changes in the course schedule or on the exam day without this information. In certain circumstances, participation in an exam may be jeopardized if you do not provide this data.
Where required (e.g., Cambridge B2 First, C1 Advanced, and C2 Proficiency), you also agree to have a photo taken on the exam day with your registration, as this consent is a mandatory part of the exam registration. Likewise, a request for reasonable accommodation can only be reviewed and approved if you provide the necessary information and the medical certificate.
We transmit the aforementioned data (name, first name, date of birth, and possibly photo or request for reasonable accommodation with a certificate) to the exam provider (Cambridge English Assessment, ETS, etc.) to fulfill the contract. These data are also forwarded to the personnel responsible on the exam day to maintain attendance lists and to contact you in case of emergency.

1. Conclusion of the Contract
The contract is concluded with the registration for a course/program/seminar and acceptance by the Test Centre. A minimum number of participants is required for courses and exams to take place. Registrations are binding and a prerequisite for participation, and also commit to the payment of the participation fee. Participants under 18 years of age must be registered with the written consent of their legal guardians (on the registration form). Registrations for minors must therefore be submitted in writing by mail, fax, or email. Adults can also register their children through the booking portal, provided they make the payment there. All forms of registration are binding!
2. Payment of the Participation Fee
The participation fee or specified deposit is due upon binding registration.
3. Scope of Services
The scope of services is derived from the description of the respective course/seminar/program by the Test Centre Amberg. Any changes require written form and can only be confirmed by the Test Centre, not by the course instructors. For exams, you can see the scope of services from the description provided by the respective exam provider.
4. Right of Withdrawal
The Test Centre can withdraw from the contract if the minimum number of participants for an event is not reached, in case of the absence of the course instructor, or for other reasons not attributable to the Test Centre. The participant can withdraw from courses/programs/seminars by written declaration, which must be received by the Test Centre at least one week before the first session. A special withdrawal period applies to certificate programs. After the one-week period or after the start of the course, a medical certificate is required. In this case, a cancellation fee of 25% of the course fee and the proportional fee for already attended and elapsed course sessions up to the receipt of the certificate at the Test Centre will be charged. Certificates submitted after the end of the course cannot be considered.
For exam registrations (Cambridge, TOEIC®, TOEFL®, WiDaf®), withdrawal is generally not possible after the registration deadline. However, you have the option to submit a medical certificate within 12 days after the exam date, in which case you will receive a partial refund of the fees. The current rates can be found on the registration form of the respective exam provider.
5. Copyright
Photography, video, and audio recordings are not permitted during events. Distributed teaching material may not be reproduced without the permission of the Test Centre, this also applies to any materials from the instructors.
6. Liability
The liability of the Test Centre for damages of any kind, regardless of the legal grounds, is limited to cases where the Test Centre is guilty of intent or gross negligence. The Test Centre Amberg assumes no liability in case of loss or theft.
7. Miscellaneous
Oral side agreements are not valid.
8. Force Majeure
Force majeure refers to serious, unforeseeable events such as war, terrorism, pandemics, epidemics, or labor disputes that are beyond the control of either party and partially or completely hinder one of the parties from fulfilling their obligations. This also includes natural events such as floods and fire damage, as well as strikes, official orders, lawful lockouts, and other business closures not caused by the parties. In the event of contractual obligations being prevented due to force majeure, the affected party must promptly inform the other party of the occurrence and cessation of the force majeure. They will make every effort to remedy the force majeure and minimize its effects as much as possible.
9. Invalidity of Individual Provisions
Should any part of the contract be invalid, this does not affect the overall contract.
